Following the entry into force of the Regulation (EU) 2015/2424 on the EU trade mark, on 6 July the European Commission published the new guidelines for customs on in-transit goods suspected of infringing IPRs

In application of Regulation 2015/2424, trade marks owners now benefit from the possibility to prevent third parties from violating their rights on goods, even if those are not intended to be placed on the market of the EU (so-called “in-transit” goods). oriGIn is in favor of giving GI beneficiaries the same right on in-transit goods infringing GIs: http://www.origin-gi.com/images/stories/PDFs/English/Lobby/Enforcement/Draft_Report_enforcement_IPRs__oriGIn_amendment.pdf
