The book “LA REGULACIÓN DE LAS DENOMINACIONES DE ORIGEN NO AGRÍCOLAS” has been recently published. The author, Pilar Montero García-Noblejas, is an Associate Professor, accredited as a Full Professor of Commercial Law at the University of Alicante. She is also the Director of the Magister Lvcentinvs, the Master’s in Intellectual Property and Digital Innovation at the University of Alicante (Spain’s first specialized master’s program) and an associate member of oriGIn.

This book analyzes how non-agricultural geographical indications (GIs) are regulated in Spain and other jurisdictions, with the goal of fostering a culture of industrial property to protect cultural heritage and promote sustainability. The study examines the various systems used to protect non-agricultural GIs in Spain, as well as in other countries, both within the European Union (including Italy, Germany, Portugal, and Hungary) and internationally (such as Switzerland, India, Colombia, Chile, and Mexico). It also includes an analysis of recent legal reforms in this area within the European Union. The study compares the GI system with other frameworks for protecting unique products’ names and explores how this protection can be complemented with other intellectual property rights, such as trademarks or designs, particularly in light of digital innovations.

The study highlights the distinctive characteristics of GIs as a tool especially suited to promoting essential national and regional interests, such as combating depopulation, supporting cultural heritage protection, and fostering sustainable production practices. GIs serve as a strategic tool for developing small and medium-sized enterprises (SMEs) and tourism, while promoting high-quality, local production.

The publication of this book is particularly timely, as the European Union has recently introduced the possibility of protecting geographical indications for handicraft and industrial products at the Union level. This study provides a basis for assessing the impact of the future EU Regulation on manufacturers of unique handicraft and industrial products, supporting the preservation of history and tradition.
