Each year, the Office of the United States Trade Representative (USTR) conducts a review of the state of intellectual property (IP) protection and enforcement in U.S. trading partners around the world. The results are published in the Special 301 Report: https://ustr.gov/issue-areas/intellectual-property/special-301
In this context, interested parties can send comments to the USTR. On January 24, oriGIn submitted its considerations in view of the publication of the 2025 Special 301 Report, expected in April this year. They refer to the comments of the 2024 Special 301 Report on the legislative initiatives in the field of GIs of the European Union (EU), its Member States, of other countries (among others China, Indonesia, Brazil, Ecuador, Mexico, Thailand, Vietnam), and of the World Intellectual Property Organization (WIPO).
oriGIn comments – which cover the relations between trademarks and GIs, the principle of territoriality in IP, the EU unitary system for craft and industrial GIs and the WIPO Lisbon System –can be found at: https://www.regulations.gov/comment/USTR-2024-0023-0008 or downloaded here .
The 2024 USTR Special 301 Report – to which oriGIn comments refer – can be found here.
oriGIn supports robust IP laws and enforcement mechanisms, in respect of well-established and internationally recognized IP principles.
